Online Banking Disclosure

The Online Banking service is provided to Interior Federal (IFCU) members free of charge. A companion Online-accessible bill payer service is also available free of charge.  This disclosure describes your rights and obligations as a user of IFCU Online Banking.  By using IFCU Online Banking, you agree to be bound by all of the terms and conditions contained herein, the terms and conditions of IFCU’s Membership Agreement and Disclosures, and all other relevant agreements, all of which are incorporated herein by reference as though fully set forth.  IFCU may change the terms and conditions herein at any time, and you will be notified of such changes as required by law.

You authorize and agree to our use of the services of third party vendors, and our disclosure of any and all information, including non-public personal information and personally identifiable financial information (as such terms are defined in the Gramm-Leach-Bliley Act and its implementing regulations, and in Title 12 of the Code of Federal Regulations Part 1016, Privacy of Consumer Financial Information and Appendix B to Part 748) when we deem such disclosure to be necessary or appropriate to initiate, complete or facilitate any transaction you order us or our agents to make.

You warrant and agree that you will not use IFCU accounts or services to make or facilitate any illegal or prohibited transaction(s) as determined by applicable law or the terms and conditions of this agreement, as applicable; and that any such illegal, prohibited or authorized use will constitute an event of default under this agreement. You agree that the IFCU will not have any liability, responsibility or culpability whatsoever for any such illegal, prohibited or unauthorized use by you or any authorized user(s). You further agree to indemnify, defend and hold IFCU harmless from any claims, suits, liability, damages, costs, expenses (including reasonable attorneys’ fees) or adverse action of any kind that arises out of or relates to, directly or indirectly, your illegal or prohibited use of an IFCU account or service, including without limitation the IFCU Online Banking described herein. This indemnity will survive termination of your account(s) and this agreement.

Privacy and Confidentiality

Protecting your privacy is of great importance to IFCU. We maintain a strict confidentiality policy to protect not only your financial assets, but also your personal information. Scheduled Availability for IFCU Online Banking

IFCU Online Banking will normally be available 24-hours a day, seven days a week, but we make no representation or warranty regarding availability. Occasionally, the system will be unavailable because of software or hardware upgrades and/or maintenance, or other event(s) beyond IFCU’s control.

Transaction Posting Times

Transfers made through IFCU Online Banking will be immediately reflected on the “To Account” Balance and the “From Account” Balance on your Transfer/Payment receipt, and they will appear on the online Transaction Log, accessible through the Online Banking menu. Transfers will also be reflected on the Available Share Savings and Share Draft Account Balances on the Account Summary and Account Detail screens at the time that you submit the transfer request and will be posted at that time. Accordingly, the actual transfers will be reflected in the Current Balance, under the Account Details or All Transaction Activity sections IFCU’s business end of day (EOD) is 4:00pm Eastern Time (ET), Monday through Friday, with the exception of holidays. Transactions occurring after this time will be included in the next business day (e.g., a transaction made at 4:30pm ET on Monday the 5th, will be included in the business day of Tuesday the 6th; a transaction made on Friday the 9th at 8:00pm ET will be included in the business day of Monday the 12th). Payments made to consumer loans, Mortgage loans and Home Equity loans will be posted on the same business day as they are made. Additionally, all authorized, and posted, transactions at the branch locations, ATM, POS, Audio Response, payroll and share draft transactions are reflected in the Available Account Balance.

Time Frame for Responding to Messages to IFCU

Your Message to IFCU is important to the credit union and will be processed in as timely a manner as possible. However, responses may take up to one week depending upon the nature of your message and other incoming letters or messages in the response queue.

Password Confidentiality

You are the key to safeguarding the confidentiality of your accounts. IFCU is entitled to act on transaction instructions received using your password and account, and you agree that the use of your password will authenticate your identity and verify the instructions you have provided to IFCU and have the same effect as your signature authorizing the transaction(s). The first time you log on to the IFCU Online Banking, you must use your Audio Response PIN Code. You will then be asked to select your Online Banking Password. You should select a password that you can easily remember, but that no one else would likely guess; for example, do not select your address, telephone number or date of birth for your password. You can change your password as frequently as you desire, by selecting the Change Password option on the User Option menu. Passwords must be (6) to (32) characters in length. If you forget your password, you can call IFCU and have your password reissued, provided you are able to provide sufficient identifying information that is linked to your account. Security of IFCU Online Banking and the Online

When you are using IFCU Online Banking, you are using a secure site. IFCU is committed to online technology and has taken steps to ensure that accessing your accounts via the Online is safe and secure, by implementing state-of-the-art security standards.

Additionally, we allow you to select a password of your choosing that will be easy for you to remember and keep “secret.” This password is used to authenticate you each time you log on to the IFCU Online Banking system, prior to allowing you to begin viewing your information. The confidentiality of your accounts is maintained as the data is passed from our host computer to your personal computer in an encrypted format, where your browser then decodes the information for you to view. This prevents the data from being intercepted and/or viewed by an unauthorized third party. IFCU has secure firewalls to ensure that no unauthorized access is permitted. These firewalls have also been tested by an independent professional services consulting firm to ensure that they cannot be breached. Additionally, each user session is set up for a specific period of time; when it is exceeded the session times out. If your session times out, and you are not finished using IFCU Online Banking, you will need to log on again. This reduces “the window of opportunity” for an unauthorized user to access your account information if you walk away from your computer without logging off IFCU Online Banking. Every effort was made along the way, as the system was designed and developed, to ensure that this system is as secure as possible. 

IFCU is not responsible for providing any equipment, software, services or advice related to equipment necessary to interface with our system, and is not responsible for any error(s) in connections, transmissions, or otherwise regarding any system, software, entries or instructions.  IFCU is further not responsible for any viruses, worms, Trojan horses, or other software routines or hardware components designed to grant unauthorized access to or disable, erase or otherwise harm your device(s) that you may encounter. You are responsible for the purchase, set-up and maintenance of your home computer and/or other device(s) with a web browser.  You must supply and use virus protection programs for your home computer and/or other device(s).

The credit union is confident that offering you Online Banking through IFCU Online Banking is safe and that your account information remains confidential, as long as you follow safe computing standards.

Your Responsibility to Prevent Unauthorized Access to Your Accounts

Interior Federal is confident that we have taken all of the necessary security precautions to ensure that our Online Banking service is secure and that your account information remains confidential. However, it is also your responsibility to play an active role in protecting the security of your accounts. Following are ways that you can protect yourself and your accounts:

  • Never share your password with anyone. If you are the only one who knows your password, you have protected your accounts against unauthorized access. We recommend that you change your password on a regular basis; but you should always change your password immediately if you think that your password may have been compromised, contact the credit union immediately.
  • Do not walk away from your computer in the middle of an active Online Banking session. If you are logged on, and walk away, anyone can sit down to your computer and have immediate access to your account(s). Always remember to log off when you are finished with your session.
  • IFCU strongly recommends that you clear your browser’s cache after you leave the IFCU Online Banking site. This prevents someone else from being able to view your account information, which is temporarily stored on your computer. You can clear your cache two ways: 1) close down your browser and then re-initiate it; or, 2) you can clear your cache, without closing your browser, by using the instructions provided in your browser’s online help system or your browser’s preferences menu.
  • For maximum security when viewing your account information over the Online, IFCU strongly recommends that you use a browser with 128-bit, U.S. security level, and encryption.

Your Conduct

You agree not to use IFCU Online Banking or the content or information delivered through the service in any way that would: (a) infringe any third-party copyright, patent, trademark, trade secret, or other proprietary rights or rights of publicity or privacy, including any rights in the software; (b) be fraudulent or involve the sale of counterfeit or stolen items, including, but not limited to, use of IFCU Online Banking to impersonate another person or entity; (c) violate any law, statute, ordinance or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination or false advertising); (d) be false, misleading or inaccurate; (e) create liability for us or our affiliates or service providers, or cause us to lose (in whole or in part) the services of any of our service providers; (f) be defamatory, trade libelous, unlawfully threatening or unlawfully harassing; (g) be perceived as illegal, offensive or objectionable; (h) interfere with or disrupt computer networks connected to IFCU Online Banking; (i) interfere with or disrupt the use of IFCU Online Banking by any other user; or (j) use IFCU Online Banking in such a manner as to gain unauthorized entry or access to the computer systems of others.

You consent and agree that your use of a keypad, mouse or other device to select an item, button, icon or similar act/action while using any electronic service we offer; or in accessing or making any transactions regarding any agreement, acknowledgment, consent, terms, disclosures or conditions constitutes your signature, acceptance and agreement as if actually signed by you in writing.

Viewing IFCU Online Banking Screens

The information displayed on the IFCU Online Banking screens may appear differently from PC to PC depending upon the size of your PC monitor, the type of browser you use and the version of the installed browser. Additionally, some functionality may be slightly different; e.g., the Download QIF screens are different depending upon the Online browser you are using.

  1. TYPES OF AVAILABLE TRANSFERS AND LIMITS ON TRANSFERS
    1. Online Banking

        1. Obtain balances and other account details on your share and loan accounts.
        2. Make transfers between your share savings and share draft accounts and from your share savings and share draft accounts to pay your credit union consumer loans, Overdraft Protection Line of Credit, Home Equity Loan and Mortgage loan.
        3. Review transaction activity on your share savings, share draft, and loan accounts, including the payment date and amount for any specific share draft and the date and amount of any deposit or dividend credited to your share savings or share draft account.
        4. Obtain selected information on your loan accounts, including information such as the balance, due date of the next payment and the amount necessary to pay off your loan.
        5. Download selected transactions from share savings and share draft accounts to personal financial management software including Quicken®.
      2. Transfer Limitations. There is no limit on the number of transfers from your share savings account if they are made in person, by ATM, by mail, or to make monthly payments on IFCU loans.
      3. The Online functions and limitations of IFCU Online Banking service may be updated, without notice, at the option of Interior Federal in order to provide improved service to the membership. Your use of the IFCU Online Banking service after the effective date of a change(s) will indicate your agreement to and acceptance of the change(s).The Electronic Fund Transfer Act and Regulation E require disclosure of the following information relating to Electronic Fund Transfer.

  1. YOUR LIABILITY FOR UNAUTHORIZED TRANSFERS
    1. Liability Disclosure. By applying for Online Banking, you agree to accept responsibility for protecting the integrity of your Password, in order to prevent unauthorized transactions and/or Online Banking. You also agree that IFCU may revoke Online Banking if unauthorized Online Banking and/or transactions occur as the apparent result of your negligence in safeguarding the Password. Further, you agree that, if IFCU is notified that you have included the credit union in the filing of a petition of bankruptcy, IFCU may revoke or refuse to grant you Online access to your account. You may elect to authorize Online access for up to two authorized users, in addition to yourself. If you desire another person(s) to have access to your account via the Online, they must be a joint owner on your account as a member-owner. Granting access to your account via the Online to a non-signer will make you financially liable for all unauthorized access, losses or misuse of the account, until reported to IFCU.

Notify us AT ONCE if you believe your account has been accessed without your authority. The best way to minimize your possible loss is to telephone us, although you may advise us in person, or in writing. If you call, we may also require you to present your request in writing within fourteen (14) days after you call. If you do not notify us, you could lose all the money in your account (plus your maximum overdraft protection line of credit amount). If you tell us within two (2) business days after you learn of unauthorized access, you can lose no more than $50 if someone accesses your account without your permission. If you do NOT tell us within two (2) business days after you learn of the unauthorized access and we can prove we could have stopped someone from accessing your account without your permission if you had told us, you could lose as much as $500.

If your statement shows any electronic fund transfer you did not make or authorize to be made, advise us at once. If you do not tell us within sixty (60) days after the first statement which reflected the unauthorized transfer was mailed to you, you may not get back any money you lost after the sixty (60) days, provided we can prove that we could have stopped someone from taking the money if you had told us in time.

If a good reason (such as a long trip or a hospital stay) kept you from telling us, we may extend the time periods.

  2. DOCUMENTATION OF TRANSACTIONS
    1. Periodic Statements. You will get monthly share savings and share draft account statements for each month in which you initiate electronic transactions via an ATM, debit at the point of sale, Audio Response, or the Online. In any case, you will get a share savings account statement at least quarterly.

Additionally, through the Online Banking service, you can view all of your share savings and share draft transaction activity at any time.

  1. TRANSACTION FEES
  1. IFCU does not charge for the right to access your account via the Online. IFCU reserves the right to charge for Online Banking services. You will be given at least twenty-one (21) days’ advance notice before IFCU implements any changes or fees for any Online Banking related service.
  1. LIABILITY FOR FAILURE TO MAKE TRANSFERS If IFCU does not complete a transfer to or from your account on time or in the correct amount according to our agreement with you, we will be liable for your losses or damages. However, there are some exceptions. We will NOT be liable, for instance:
    1. If, through no fault of ours, you do not have enough money in your account or available credit in your Overdraft Protection Loan Line of Credit to make the transfer.
    2. If the funds in your account are subject to legal process, such as garnishment or attachment, or if the account is subject to a pledge or security agreement.
    3. If despite reasonable precautions that we have taken, circumstances beyond our control (such as fire, power failure, flood or failure of paying agency to deliver direct deposit payment data) prevent the transfer.

You expressly agree that use of IFCU’s website and IFCU ONLINE BANKING SERVICES is at your sole risk. FURTHER, YOU EXPRESSLY AGREE IFCU’s WEBSITE, IFCU ONLINE BANKING SERVICES AND RELATED DOCUMENTATION ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.   1. ACCOUNT INFORMATION DISCLOSURE We will disclose information to third parties about your account or the transactions you make under certain circumstances, including but not limited to:
    1. If we return checks on your account drawn on insufficient funds or if we are unable to complete an electronic transfer because of insufficient funds.
    2. When it is necessary for completing transfers.
    3. In order to verify the existence or conditions of your account for a third party, such as a credit bureau or merchant.
    4. In order to comply with government agency or court orders.
    5. If you give us your written permission.
  1. TERMINATION

IFCU Online Banking services remain in effect until terminated by you or us. You may cancel your IFCU Online Banking services at any time by notifying us of your intent to cancel in writing to us at Interior Federal, 1849 C ST NW ROOM B038, Washington, DC 20240, or by calling us toll-free at: 800-914-8619; or if in metro Washington DC, or outside the contiguous United States at: 202-208-3936. This cancellation applies only to your IFCU Online Banking services and does not terminate your other relationships with us.

We may terminate your participation in the IFCU Online Banking services for any or no reason including without limitation inactivity, in our sole and absolute discretion, at any time without prior notice to you. We may notify you in advance of any termination, but we are not obligated to do so. Further, IFCU Online Banking services are available only to members in good standing. If at any time we determine that you do not meet our criteria for this service, we may terminate your participation without notice and without liability to you. IFCU will have no liability or obligation to you whatsoever with regard to any transaction after the date of termination. Termination of your participation in the IFCU Online Banking services will automatically terminate any pending payments.

  1. IN CASE OF ERRORS OR QUESTIONS ABOUT YOUR ELECTRONIC TRANSFERS

as soon as you can, if you think your statement or receipt is wrong or if you need more information about a transaction listed on the statement or receipt. We must hear from you no later than sixty (60) days after we send the FIRST statement on which the problem or error appeared.

  1. Tell us your name and account number.
  2. Describe the error or the transaction you are unsure about and explain as clearly as you can why you believe it is an error or why you need more information.
  3. Tell us the dollar amount of the suspected error. If you tell us orally, we may require that you send us your complaint or question in writing within ten (10) business days we will tell you the results of our investigation within ten (10) business days after we hear from you and will correct any error promptly. If we need more time, however, we may take up to forty-five (45) days to investigate your complaint or question. If we decide to do this, we will re-credit your account within ten (10) business days for the amount you think is in error, so that you will have the use of the money during the time it takes us to complete our investigation. If we ask you to put your complaint or question in writing and we do not receive it within ten (10) business days, we may not re-credit your account.

If it is determined there was no error, we will send you a written explanation within three (3) business days after we finish our investigation. You may ask for copies of the documents that we used in our investigation.

  1. MISCELLANEOUS

This agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflicts of laws provisions. You may not transfer or assign any rights or obligations under this agreement to any party, person, or entity without our prior written consent, which we may withhold in our sole discretion.  We reserve the right to transfer or assign this agreement or any right or obligation under this agreement at any time to any party.  If any provision of this agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. We shall not be deemed to have waived any rights or remedies unless such waiver is in writing and signed by an authorized representative. A waiver on any one occasion shall not be construed as a bar or waiver of any other rights or remedies to subsequent occasions. Any terms contained herein that by their nature should survive shall survive the termination of this agreement.  This agreement supersedes any prior agreements or communications, oral or written, between you and IFCU regarding the IFCU Online Banking services.

NOTE: Your use of the Service constitutes acceptance of these Terms & Conditions.

By AGREEING WITH THE TERMS & CONDITIONS I agree and authorize my Financial Institution to monitor transactions on my linked payment card to identify qualifying transactions and to share details of that transaction (such as the date, time, and amount) with My Rewards and its service provider, Collinson CLO, Inc. I authorize My Rewards and Collinson CLO, Inc. to use and share my data to enable card-linked offers, calculate rewards, present me with targeted offers and facilitate the My Rewards program, as described therein. I may opt-out of transaction monitoring on my account by going to the applicable opt-out page.

  1. Legal Contract Age

YOU MUST BE AN INDIVIDUAL, 16 YEARS OF AGE OR OLDER. Members must be human and using the Service for personal not commercial use: no machines, scripts, or automated services may be used to accumulate any financial benefits derived from the use of the Service. You may maintain only one account. Any duplicate accounts will be subject to cancellation.

  1. My Rewards cash back 

Once you have completed a Qualifying Purchase (as defined in the applicable offer), cash back earned will accrue in your account within 30 days after your purchase. It is your responsibility to check your checking account regularly to ensure that cash back has been properly credited and that your account balance is accurate. Cash back is awarded subject to adjustments for returns, cancellations, and other events. Such adjustments can be applied to your checking account at any time. Should you disagree with any adjustments made to your checking account, your sole remedy is to withdraw from the Service. Interior Federal reserves the right to terminate any account for abusive or fraudulent activity. 

  1. Account Eligibility

Should you have multiple checking accounts, you will only be able to earn cash back through transactions made using one of your checking accountsThis account will be enrolled when you join up to My Rewards. Offers can only be linked to this checking account and only qualifying transactions made using this checking account will be eligible for cash back. We cannot change the checking account nor can we add additional checking accounts.

  1. Transaction Eligibility

Not all transactions with your enrolled checking account are tracked. You acknowledge that we may be unable to monitor every transaction made with your enrolled checking account. In the event that you have registered your card or checking account across multiple Collinson affiliate programs, and the merchant is registered with more than one such affiliate program, the eligible transaction will apply to the offer that was created/registered for first.

  1. Third Party Sites

You understand that Collinson CLO, Inc. does not operate or control the products or services offered by third parties, promotional partners or participating Affiliates. Third-party Web sites and online merchants accessed through the My Rewards site are responsible for all aspects of order processing, order fulfilment, shipping and handling, billing and customer service. Collinson CLO, Inc. is not a party to the transactions entered into between you and the merchants with which you choose to do business. If you buy products or services from third party sites you become a customer of those merchants and therefore must direct any comments, complaints or inquiries regarding your purchases to those merchants, and not to Collinson CLO, Inc. IN NO EVENT WILL COLLINSON CLO, INC.’S OR ITS AFFILIATES’, CONTRACTORS’, EMPLOYEES’, AGENTS’, OR THIRD PARTY PARTNERS’ OR SUPPLIERS’ TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PROGRAM (WHETHER IN CONTRACT, TORT INCLUDING NEGLIGENCE, WARRANTY, OR OTHERWISE) EXCEED AN AMOUNT EQUAL TO THREE TIMES THE REBATE RECEIVED BY YOU FOR THE QUALIFYING PURCHASE RELATING TO THE APPLICABLE CLAIM.

YOU AGREE TO INDEMNIFY AND HOLD COLLINSON CLO, INC., ITS PARENTS, SUBSIDIARIES, AFFILIATES, ITS AFFILIATES, LICENSORS AND SUPPLIERS AND ITS AND THEIR OFFICERS, DIRECTORS AND EMPLOYEES, HARMLESS FROM ANY CLAIM OR DEMAND, INCLUDING REASONABLE ATTORNEY’S FEES, MADE BY ANY THIRD PARTY DUE TO OR ARISING OUT OF YOUR USE OF THE SERVICE, YOUR VIOLATION OF THESE POLICIES, OR THE INFRINGEMENT BY YOU, OR OTHER USER OF THE SERVICE USING YOUR ACCOUNT, OF ANY INTELLECTUAL PROPERTY OR OTHER RIGHT OF ANY PERSON OR ENTITY, OR AS A RESULT OF ANY THREATENING, LIBELOUS, OBSCENE, HARASSING OR OFFENSIVE MATERIAL CONTAINED IN ANY OF YOUR COMMUNICATIONS. 

  1. Termination or Changes to the Program

Collinson CLO, Inc. reserves the right to terminate the Service at any time. Collinson CLO, Inc. will not be responsible for failing to notify you of Service termination where such failure is caused by any reason outside the control of Collinson CLO, Inc. including, but not limited to, any failure by the Financial Institution to notify you of such termination or your failure to provide up to date contact details to your Financial Institution. 

  1. Modification of Terms

Collinson CLO, Inc. may modify these Terms  & Conditions from time to time, with or without notice and your continued participation in the Service after such modification shall be deemed to be your acceptance of any such modification. It is your responsibility to check the Terms & Conditions section of the My Rewards site regularly to determine whether this Agreement has been modified. If you do not agree to any modification of this Agreement, you must immediately cease participation in the Service.

  1. Termination

Your use of the Service is subject to the Terms & Conditions. Any failure to comply, any fraud or abuse relating to the accrual of My Rewards cash back, or any misrepresentation of any information furnished to Collinson CLO, Inc. or its Affiliates by you, or anyone acting on your behalf, may result in the termination of your use of the Service, cancellation of your My Rewards account.

  1. Disputes or Errors

All questions or disputes regarding the Service must be submitted in writing within 60 days of the qualifying transaction, to Interior Federal. Any such disputes shall be resolved by Interior Federal at its sole discretion.
